Food Direct Terms and Conditions

Minimum Order
The minimum order total for free delivery is $100 including GST (excluding Beer and Wine).

Prices
All product and service prices on the Food Direct website are in New Zealand Dollars and are inclusive of GST.

Product Images
Some product images on the Food Direct website are illustrative of the products we sell and are not images of the actual products.

Product Weights
Product weights stated for some products on the Food Direct website are the estimated average weight of that product. The actual weight of the product in your order may differ - it may be slightly less or slightly more. We do our best to get as close as we can to the stated weights for each product order; however with some items it is very difficult to get exact weights. If you are not happy with the weight of any product in your order please contact Food Direct.

Product Substitution
We will do our best to fill every order, but circumstances beyond our control may cause products to be unavailable. In such event Food Direct may elect to replace a product for a similar substitute product. If you are not completely happy please contact us immediately and we will replace the product and/or refund your money.

Guarantee
We guarantee every product we deliver to you. If you are unhappy with any product in your order, please contact Food Direct straight away and we will arrange to exchange the product or make a full refund of the cost of the product to you on receipt / return of the product (our customer service representative will come and pick the product from your address at the earliest agreeable time).

Late Delivery
Due to circumstances beyond our control deliveries may from time to time be delayed. In such event our customer service team will contact you to advise you of the delay and confirm the next best delivery time. In some extreme circumstances (major disasters) we may suspend the delivery until a subsequent day or issue a full refund.

In the event we are late in making deliveries due to Food Direct error our customer service team will contact you to advise you of the delay and confirm the next best delivery time or issue a full refund at your option.

Failed Delivery
If you have not given us instructions to leave your groceries at your door and you’re not home during your selected timeslot (for example if you have an unexpected errand), we will call your cell phone number and seek instructions from you regarding redelivery. If we are back in your area later in the day and you will be home at that time we will redeliver at no additional cost however we reserve the right to charge an additional delivery fee in the event that we will not be in your area again that day and must make another special trip to deliver your order – and such redelivery fee will be $10 (including GST).

If you are not contactable by phone we will email you notice that we have tried to make delivery of your order. If you contact us within 15 hours of such notice we will do our best to redeliver your order either on the same day or the next day (we will store your order in suitable chilled environment overnight) however we reserve the right to charge a redelivery fee of $10 (including GST) and a repacking fee of $10 (including GST). If you do not contact us within 15 hours of such voicemail and/or email notification your order will be cancelled and you will not receive a refund.

Wine and Beer
Food Direct provides a structured advertising and delivery service for Wine and Beer that is sold by Ashore Fine Foods Ltd. Food Direct Ltd does not buy, stock or sell any alcoholic liquor product itself.

In the event your order includes Wine or Beer the purchase of such products will be transacted separately by Ashore Fine Foods Ltd and will appear as a separate transaction on your Credit or Debit Card statement, you will also receive a printed GST invoice from Ashore Fine Foods Ltd (with your groceries).

In the event your order includes any alcoholic liquor product you hereby warrant that you are over the age of 18 years and are legally entitled to purchase such products, and that you are not under the influence of alcohol at the time any such order is submitted.

Please note your Foodie Club discount codes do not apply to the purchase of Wine and Beer.

Receipts
Every time you make a payment online Food Direct will email you with a receipt and the details of your order and delivery time. In order to save the environment and reduce waste your order will not contain a printed receipt (except for wine and beer purchases as above) when delivered if for some reason you require a printed receipt on delivery please contact Food Direct.

General Privacy
Food Direct will retain your information to make your shopping experience easier, and if you have chosen to join our newsletter mailing list we will email you the details of specials we have running and any new products and Foodie news that might be of interest. Your user information is not passed on to any third party unless you have granted us explicit permission to do so.

Security and Credit Card Privacy Policy.
Food Direct retains your credit card details for a limited time on our secure encrypted systems to enable payment processing of your order - your credit card details are then automatically erased from our systems. All Food Direct credit card processing pages use the HTTPS - SSL protocol that provides secure and encrypted communication transfer of data on the Internet.

Unauthorized Access
You acknowledge that your username and password to the Food Direct system is your sole responsibility and agree to notify Food Direct immediately if you suspect your username or password has been disclosed to any disclosed third party.

Proprietary Rights
Food Direct is and will remain the sole owner of all trade marks, design, copyright work, and you must not copy, alter, modify or reproduce such intellectual property, or allow any other person to do so.

Warranty
Food Direct gives no warranty that the Food Direct online shopping system or the internet are fit for a particular purpose, other than that they will generally conform to and operate in accordance with processes explained on the Food Direct website. You acknowledge that you have been afforded an opportunity to preview the Food Direct online shopping systems, and that you are agree to use the Food Direct online shopping system at your own risk on the basis of your assessment thereof.

You agree that in no event shall Food Direct be liable for any incidental or consequential loss or damage including, but without limitation, loss of use, loss of data, loss of profit, or liability howsoever arising, except as otherwise expressly provided herein.
